The likelihood of confusion is the central concept of trademark law: it exists where the public may believe that goods or services come from the same undertaking or from economically linked undertakings.

Assessment

  • A global appraisal of the visual, phonetic and conceptual similarity of the signs.

  • Account taken of the similarity of the goods or services and of the distinctiveness of the earlier mark.
