What is intellectual property ?

Intellectual property refers to works of the mind: inventions; literary and artistic works; designs and models; emblems, names and logos used in commerce.

Intellectual property is nowadays omnipresent both in cultural life and in the economic sphere. It is a complex field since not only the rules relating to each intellectual property right differ, but also the legislation within the different countries.

Intellectual property rights are rights conferred to the author of an intellectual creation. They generally give the creator or inventor an exclusive right to use his creation for a certain period of time.

Intellectual property is composed of two branches: literary and artistic property, which includes copyright and related rights, and industrial property.

Copyright is a prerogative granted to the creator of a work of the mind allowing its author to have exclusive property on this work. Copyright concerns: literary creations, audiovisual creations, sound creations, visual creations, architectural creations, plays, operas, musicals, blogs, websites etc.

Unlike industrial property rights, copyright is acquired automatically, provided that the originality of the creation can be demonstrated. In other words, the creator of a work of the mind is automatically protected by the mere fact of his creation.

An artistic or literary creation is protected by copyright. This is the only right that is automatically acquired upon creation. The protection of a copyright lasts for the lifetime of the author and 70 years after his death.

The protection conferred by copyright and related rights extends to the rights of performers (actors, singers, musicians, etc.), producers of phonograms (sound recordings) and broadcasting organizations.

Industrial property rights are, as the name suggests, all rights relating to an industrial application, such as patents or trademarks. For more information on the different industrial property rights, please visit our dedicated page.

Intellectual property rights are sensitive and fragile objects when they are not sufficiently supervised beforehand. As such, it is highly recommended to call upon a lawyer specialized in intellectual property law or an intellectual property attorney, in order to secure and optimize your intellectual property rights. An intellectual property lawyer or attorney will provide you with all the elements to guide you in the elaboration of a protection strategy, and this from the genesis of your project. A lawyer specialized in intellectual property law or an intellectual property attorney will accompany you in the negotiation and conclusion of various contracts, such as copyright assignment contracts, exploitation licenses, or other.
